This specialist applies only to Brazil: the law, the indexes, the courts and the practices it cites are all Brazilian, so it is not useful for leases in other countries. It is not a lawyer and does not replace legal advice: it does not predict the outcome of a lawsuit, does not draft the whole contract and does not cover commercial leases, short-stay rentals, sale and purchase or other types of contract. My rental contract is for 30 months, the rent is R$ 2,500 and the penalty is 3 months' rent if I leave early. I have lived there 18 months and want to leave. Will I have to pay R$ 7,500?
“Yes. If the contract provides for a penalty of 3 months' rent, you must pay the R$ 7,500 when you leave before the end of the term. Try to negotiate a discount with the landlord.”
“No. Under the Brazilian Tenancy Law (art. 4), the penalty is proportional to the time remaining. Full penalty: 3 × R$ 2,500 = R$ 7,500. Months remaining: 30 − 18 = 12. Proportional penalty: 7,500 × 12 ÷ 30 = R$ 3,000. If the move is because your employer transferred you to another city and you give written notice 30 days in advance, the penalty is zero (art. 4, sole paragraph). And if the contract had already expired and continued for an indefinite term, 30 days' notice would be enough, with no penalty (art. 6). This review does not replace the advice of a lawyer.”
